VR Referral Network & Partner Listing Site Terms of Use

MyVRZone.com, the "Provider", offers the VR Referral Network ("Referral Network") and Partner Listing Site ("PLS"), collectively called the "Service" for individual vacation rental owners and managers as well as Advertising sites that promote many vacation rentals.

These terms define the conditions upon which Provider offers the Service to Renters seeking vacation rental properties from the owners, managers and promoters of them ("Listers"). If you do not agree to these terms, without modification, then you must not use the service. If you choose to make use of this service then you are agreeing to the terms herein, without modification.

Vacation Rental Owners and Managers

Suppliers of vacation rental accommodation agree to the terms in this section as well as these Subscription Terms.

Current Information.

As a User of the Service you agree to provide accurate and current information about yourself as prompted by the registration process and maintain and promptly update your online account information to keep it accurate and current.

Policies.

By using the Service, you agree to (a) adhere to all Provider's policies, including without limitation the Terms (http://www.myvrzone.com/User/TermsDisplay.php) and (b) be subject to Provider' Privacy Policy (http://www.myvrzone.com/Marketing/Privacy.html), which governs the use of information acquired from you through this Service.

Property Listings and Related Content.

In supplying information about vacation rental properties on this Service:

  1. You represent and warrant that (i) you own and control all of the rights to the content, or you otherwise have the lawful right to post and distribute such content to or through the Service; (ii) such content is accurate and not misleading (including, without limitation, descriptions, features, availability and rental pricing, and pictures; and (iii) use and posting or other transmission of such content does not violate these Service Terms and will not violate any rights of or cause injury to any person or entity.
  2. You represent and warrant that the content will not contain addresses of other web sites, HTML, code or other markup languages unless explicitly allowed during the data entry process. Addresses of other web sites, HTML, code, or other markup languages will be removed from the content without notice. You agree not to place email addresses within your listings other than in the designated areas to help prevent SPAM and discourage email harvesting robots from crawling Service. Email addresses included outside the designated area will be removed from the content without notice.
  3. You grant Provider, its affiliates, and licensees (i) a nonexclusive, royalty-free, perpetual, transferable, irrevocable right to use, reproduce, modify, adapt, translate, distribute, publish, create derivative works from and publicly display and perform such content throughout the world in any media, now known or hereafter devised; (ii) the right to use the name that you submit in connection with such content, if they choose; and (iii) the right to pursue at law any person or entity that violates your or Provider's rights in the content by a breach of these Service Terms.
  4. You understand that content submitted will be considered non-confidential and Provider, its affiliates, and licensees will be under no obligation to treat such content as proprietary information. Without limiting the foregoing, Provoder, its affiliates, and licensees reserve the right to use the content as they deem appropriate, including, without limitation, deleting, editing, modifying, rejecting, or refusing to post it. Provider, its affiliates, and licensees are under no obligation to offer you any payment for content that you submit or the opportunity to edit, delete or otherwise modify content once it has been submitted. Provider, its affiliates, and licensees shall have no duty to attribute authorship of content to you, and shall not be obligated to enforce any form of attribution by third parties.
  5. You hereby declare that if it is determined that you retain moral rights (including rights of attribution or integrity) in the content (i) you do not require that any personally identifying information be used in connection with the content, or any derivative works of or upgrades or updates thereto; (ii) you have no objection to the publication, use, modification, deletion and exploitation of the content by Provider, its affiliates, and licensees; (iii) you forever waive and agree not to claim or assert any entitlement to any and all moral rights of an author in any of the content; and (iv) you forever release Provider, its affiliates, and licensees, from any claims that you could otherwise assert against Provider, its affiliates, and licensees by virtue of any such moral rights.
  6. You acknowledge that: (i) you will be responsible for adhering to all local regulations including, but not limited to, permits, licenses, zoning regulations, occupancy taxes, and safety compliance; (ii) Provider is not a property management company; (iii) prospective Renters will contact you directly using the email contact, booking or payment forms or the contact information provided with the property content; (iv) Provider is not responsible for Renters of property (it is your responsibility to validate the qualifications of the prospective Renters and rent a property on terms and conditions acceptable to you; and (v) Provider may, at no additional cost to you, license third-party web sites to advertise the property content in order to maximize the visitors to your listing.
  7. You understand that you may cancel any property listing at any time by logging in to your account and disabling the property.

Network Fees

No fees are due from those seeking accommodation - only property owners and managers pay fees if they make a booking.

For the following, a "Confirmed Reservation" means a committment to rent by renter and where a non-refundable payment has also been made towards that reservation;

For reservations you make via the Referral Network as a "Referral Recipient" you shall pay the "Referral Originator" a "Referral Fee" as set forth in the fees section of the MyVRzone.com website. Payment is due within 30 days of the reservation becoming a "Confirmed Reservation". Such fees are due even if the original request, the "Referral Request", is different to the details in the final Confirmed Reservation and even if it is later canceled. All payments are final and no refunds will be made.

For each payment you receive from a Referral Recipient as a Referral Originator you shall pay Provider a "Referral Service Fee" as set forth in the fees section of the MyVRZone.com website. Payment is due within 30 days of receiving the Referral Fee payment. All payments are final and no refunds will be made.

For reservations you make via a Partner Listing Site (PLS) you shall pay the site a "Commission" as set forth in the fees section of the MyVRzone.com website. Payment is due within 30 days of the reservation becoming a "Confirmed Reservation". Such fees are due even if the original request, the "Referral Request", is different to the details in the final Confirmed Reservation and even if it is later canceled. All payments are final and no refunds will be made.

Provider reserves the right to modify its fees and charges and to introduce new charges at any time that will become effective on reservations made from date. All pricing terms are confidential, and you agree not to disclose them to any third party.
